These terms govern your use of westboundanalytics.com and the analytical testing services provided by Westbound Analytics ("the laboratory", "we"). By submitting a testing request or creating an account you agree to them.

Research use only

Our services are provided for research and quality-control purposes only. Test results describe the specific sample we received and analysed. They are not a statement that any product is safe, effective, legal, or suitable for any use, and they are not medical, veterinary, or regulatory advice. Nothing we provide should be used to diagnose, treat, or prevent any condition or to represent a product as approved for human or animal use.

Requests, review, and acceptance

Submitting a request is not a purchase. Every request is reviewed by the laboratory, which may accept it, ask for more information, adjust the scope, or decline it. Sample requirements and shipping instructions are released only after approval. Do not ship samples before then; unapproved samples may be refused or discarded.

Samples

You are responsible for the samples you send: for accurately describing them, for lawfully possessing and shipping them, for packaging them safely, and for any customs or carrier requirements. We may refuse, hold, or dispose of samples that are damaged, leaking, mislabeled, hazardous, or not as described. Unless we agree otherwise in writing, remaining sample material is retained for a limited period after reporting and then discarded.

Pricing and payment

Pricing is confirmed with you directly after review, unless a valid promotional code makes the work free. Payment terms are agreed before a certificate is released. Where payment is due, we may withhold release of results until it is received.

Results and certificates

Results reflect the sample as received, analysed using the methods stated on the certificate, and are subject to the uncertainty inherent in those methods. A certificate may be revised or withdrawn if an error is found; the verification page always shows the current status. You may share your certificate, but you may not alter it, remove its verification code, or present it as applying to any lot, batch, or product other than the sample tested.

Accounts

Keep your password confidential and notify us of any unauthorised use. You are responsible for activity under your account. We may suspend accounts used to abuse the service, submit fraudulent requests, or interfere with the site.

Intellectual property

The site, its design, text, and software belong to Westbound Analytics or its licensors. Certificates are laboratory records; you receive a licence to use and share your certificate for lawful purposes.

Disclaimers and limitation of liability

Services are provided "as is". To the fullest extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose. Our total liability for any claim arising from a testing request is limited to the amount you paid for that request. We are not liable for indirect, incidental, consequential, or lost-profit damages, or for decisions you make in reliance on results.

Indemnity

You agree to indemnify Westbound Analytics against claims arising from your samples, your use of results, or your breach of these terms.

Governing law

These terms are governed by the laws of the State of West Virginia. Disputes will be resolved in the state or federal courts located in Berkeley County, West Virginia.
